Who decides
Light Time Decides Who Can Decide
Autonomy is discovered, not granted.
At 2.6 seconds round trip the Moon can be run from Earth; at 4-24 minutes each way Mars cannot. No decision that needs an answer inside about 48 minutes can be made on Earth for Mars, so authority moves to the settlement whatever any charter says. The full control-mode table is on The Substrate Tables.
Jurisdiction follows the registry under Article VIII of the Outer Space Treaty. A settlement built from modules registered by different states has overlapping jurisdictions with boundaries running through its hatchways.
The Sovereignty Ladder
Three Rungs, and the Third Is Two Things
Political sovereignty is an event; functional independence is a capability.
| Rung | Example | Ceiling | Rated |
|---|---|---|---|
| Industrial only, no people required | Belt outposts; deep-space compute | Set by local geochemistry | Modeled |
| Industry and people, governed from Earth | The Moon; crewed belt bases | The Moon stays here, correctly | Modeled |
| Functional independence | A Mars settlement that survives losing Earth | Not reached by 2075 | Modeled |
| Political sovereignty | A self-governing polity | Can happen at any rung | Modeled |
The Mars hedge needs independence, not sovereignty. The failure mode is that sovereignty arrives first: the event is gated by biology and a family's decision, independence by a multi-decade industrial program, and nothing sequences them. A redundancy program that takes on an irrevocable obligation before it is independent has turned a hedge into a liability.
Shared failure modes
Mars Shares Six of Nine Critical Inputs With Earth
A second instance that shares failure modes with the first is not redundancy.
| Input | Shared | Note | Rated |
|---|---|---|---|
| Fissile material | Yes | Unknown, not ruled out; no survey | Modeled |
| Pu-238 | Yes | Trace stock; a few kilograms | Modeled |
| Helium | Yes | Purge and leak-check demand unquantified | Modeled |
| Devices | Yes | Mars is the one body where a chip line could close | Modeled |
| Spares | Yes | Machining fails the mass test past the Moon | Modeled |
| People and certification | Yes | Until a second generation trains locally | Modeled |
| Halogens | No | About 300× lunar chlorine | Modeled |
| Iridium | No | By substitution, not supply | Modeled |
Three of the shared six weigh a few hundred kilograms a year. A settlement can make its own structure, propellant, oxygen, water and food and still be a branch office. Independence is not a declaration; it is the progressive removal of shared failure modes.
One settlement is one Martian failure domain, and a second is not a cheap copy. Placed close enough to share the mine, landing field and power plant, it stays inside the same failure domain; placed far enough to be independent, nearly every expensive system is duplicated. The same tons and megawatts might buy more survival as a second reactor technology, a diverse seed bank or an orbital refuge. Early growth is more likely to come as dense, fault-contained clusters, each with its own pressure boundary, power section and refuge.
Operations first
Mars Governs Itself Before Anyone Grants It
Constitutional language comes after the emergencies.
Earth-Mars light time makes safety response, medical decisions, equipment isolation and emergency command local from the first crewed mission. Governance emerges from operations: who controls the power bus, who commands during an atmosphere leak, who allocates scarce medical resources, who can ground a ferry, who owns the farm, and who can deny access to the only safe refuge.
Modules, reactors and habitats may sit under different national registries and corporate owners while the people inside share one air system. Children sharpen the mismatch: jurisdiction follows registered installations, but nationality descends through terrestrial law that never planned for birth on ground no state may claim. A Mars-born adult may also be unable to tolerate Earth gravity, which removes evacuation as a universal fallback.
Who Goes
Composition Binds, Not Population
About 103 to 104 people off Earth through 2075; what matters is who they are.
| Cohort | Brings | Weakness | Rated |
|---|---|---|---|
| Employer-sponsored workers | Training budget, equipment skills, rotation policy | Ends when the employer reallocates capital | Modeled |
| Sovereign-backed cohorts | Long-horizon funding, national logistics | Political cycles and recall | Modeled |
| Research personnel | Specialization, expeditionary culture | Small numbers, narrow industrial breadth | Modeled |
| Free-agent technologists | Motivation, risk tolerance, breadth | Too few to staff the work at scale | Modeled |
| Commitment-based communities | Multigenerational continuity | Weak overlap with certification; consent questions | Modeled |
| Second generation | Continuity without recruitment from Earth | Cannot responsibly exist until biology and medicine are understood | Modeled |
The Moon supports a rotation culture, closer to offshore energy or polar work than emigration. At Mars, travel time and windows merge employment with migration, and compensation moves from hazard pay toward stakeholding: housing, family, return rights and eventually a say in local governance. The useful metric is qualified worker-years retained, not arrivals.
| Crew in place | Career length | Trained a year | Rated |
|---|---|---|---|
| 1,000 | 4.2 years | 238 | Modeled |
| 1,000 | 20 years | 50 | Modeled |
| NASA, 1959-2026 | - | About 5.5 selected | Observed |
A fixed lifetime dose is worth more spent by someone with fewer years left, so a dose-limited workforce is older - the opposite of the colonization story. The template is the US naval nuclear program, which trains about 1,500 operators a year and has kept everyone under 5 rem a year since 1968 under a formal radiation-worker regime.
The first child born off Earth is a constitutional event, not a milestone. A worker accepted the assignment and an adult settler chose to go; a locally born child did neither, so abandonment stops being a budget decision and becomes an act against identifiable people. Permanence and consent are the same event seen from opposite ends. An earlier line is the first adult who cannot be brought home: the day a settlement's population exceeds its evacuation capacity, decided by not building a second ferry.
| Phase | Dominant population | Defining characteristic | Rated |
|---|---|---|---|
| Expedition | Small, highly selected crews | Mission logic; direct dependence on Earth | Modeled |
| Industrial outpost | Rotating operators and specialists | Sized by crew-hours, dose and skills | Modeled |
| Professional community | Repeat workers and long residents | Retention becomes economically important | Modeled |
| Settlement threshold | Families and civil institutions | Employment no longer explains the population | Modeled |
| Second generation | Locally born people | Permanence becomes political and biological | Modeled |
Not every destination climbs this ladder. The Moon may stay a professional outpost; asteroid sites may stay machine-run; Mars is the strongest candidate for the full transition. Ten thousand rotating workers can still be an outpost system, and a much smaller community with locally born children has already crossed the larger boundary.

Two Lunar Coalitions, One Contested Site
Artemis and the ILRS both target the lunar south pole.
| Program | Position | Rated |
|---|---|---|
| ILRS · CNSA and Roscosmos | Agreement May 2025; basic station 2035; nuclear power station 2035 | Projected |
| Crewed landing · CMSA | Date held in public: before 2030 | Building |
| Mars sample receiving lab · CNSA | The only one on Earth after Mars Sample Return was cancelled | Observed |
| Artemis · NASA | Resequenced in public; first landing Artemis IV, 2028 | Building |
Rival and excludable goods - cold traps, landing sites - turn occupation into the rule. Between two state programs at Shackleton there is no arbitrator; see The Moon.
Contested
Deliberately Not Claimed
The load-bearing uncertainties, tagged with the confidence they actually earn.
The fissile row is unknown, not a no. If concentrated ore is found on Mars, the audit drops a row and independence moves decades earlier.
Ownership is a governance problem with no analogue. A polity where the oxygen is a corporate asset and the only exit is run by the same party has no precedent; company towns were bounded by being able to walk out.
